Harding County Marriage Licenses
Marriage licenses in Harding County are issued by the Harding County Clerk. The county states that a New Mexico County Clerk's Office is the only agency permitted to issue a marriage license in the state. The application and the marriage certificate become permanent county records after the license is issued and returned. Harding County processes applications during weekday clerk hours, with a separate same-day application cutoff, and the license can be used right away once it is issued.
Applicants must appear in person unless a District Judge authorizes issuance when one applicant cannot appear. Each applicant needs proof of age and identity, usually a government-issued photo ID. The county does not require a blood test, and the license does not expire. A Harding County license is valid only for a ceremony that takes place in New Mexico, so a couple planning an out-of-state ceremony should not rely on a Harding County license.
The Harding County marriage information page is the source for the license workflow shown here.
The county page matters because it gives the local timing rule, fee notice, appearance rule, and return requirement for the certificate.
Apply for Harding County Marriage Records
A marriage license application in Harding County is a clerk-office transaction, not a court hearing. Plan enough time for staff review because the county says license issuance takes about 30 minutes and no license will be started after the daily cutoff. The office also requires a Witness Form to be returned with the marriage certificate so the certificate can be recorded accurately after the ceremony.
- Complete the information sheet required for each applicant before or during the visit.
- Bring proof of age and identity for each applicant, normally a current government photo ID.
- Have all applicants appear in person, unless a District Judge has authorized an exception.
- Pay the marriage license fee when applying. Harding County lists cash or check as the payment methods.
- After the ceremony, return the signed certificate and the county Witness Form so the record can be filed.
Minor applicants have extra proof and consent rules. A 16- or 17-year-old applicant must provide a certified birth certificate. Both living parents shown on that birth certificate must provide written consent, either in person or by notarized statement. If one parent is deceased, the county requires a certified death certificate. If consent cannot be obtained from a living parent, or if the applicant is under 16, a District Court order is required.
Harding County Marriage Application Fields
No separate downloadable Harding County marriage application form was located in the official research. The county does say each applicant must complete an information sheet, prove age and identity, and meet relationship and existing-marriage limits. The field inventory below therefore uses only facts supported by the county page, not guessed form labels.

Harding County Marriage and Divorce Fees
Harding County's marriage page lists the current local license amount and payment method. Divorce costs come from the Tenth Judicial District fee schedule because divorce records are District Court records. The fee table keeps these sources separate, which is important when a person needs both a marriage certificate and later a divorce decree.
| Item | Amount | Office |
|---|---|---|
| Marriage license | $55.00 | Harding County Clerk |
| Domestic case filing | $137.00 | Harding District Court |
| Divorce packet with children | $31.50 | Tenth Judicial District |
| Divorce packet without children | $27.30 | Tenth Judicial District |
| District Court photocopies | $0.35 per page | Tenth Judicial District |
| District Court certification and seal | $1.50 per pleading | Tenth Judicial District |
The marriage fee increased effective June 20, 2025 after Senate Bill 290 was signed on April 8, 2025, according to the Harding County marriage notice. Tenth District Court payment rules are different from the County Clerk's marriage-license rule: personal checks are not accepted for District Court fees, cash must be exact, and money orders should be payable to the 10th Judicial District Court.
The Harding County Probate Court page is also relevant because the County Clerk serves probate functions in addition to issuing marriage licenses.
That county source is useful because marriage, probate, and clerk duties overlap at the same local office, while divorce remains a District Court case type.
Search Harding County Marriage Records
Marriage-record searches can be made in person through the County Clerk at 35 Pine Street in Mosquero, by phone at 575-673-2301, by mail to P.O. Box 1002, Mosquero, NM 87733, or through the CountyFusion/Kofile recorded-document system. The county clerk's records page warns that staff do not conduct searches and cannot perform title or abstract research, so a requester should bring names, approximate dates, and any known document detail.
CountyFusion has a specific Marriage License search type. The portal also warns users to read disclaimers, try spelling variations, and expect copy or printing fees if documents are printed. A watermark may appear on an unpaid document image, and the county says it is removed once documents are paid for and printed.

The U.S. Bankruptcy Court for the District of New Mexico is not a Harding County marriage source, but its separate federal records system is a reminder that domestic, county, and federal records do not sit in one database.
Use the federal court source only when the record sought is a federal case, not a Harding County marriage license or divorce decree.
Find Harding County Divorce Records
Divorce records are not marriage-license records. Harding District Court handles divorce cases, and public case information may be searched through New Mexico Case Lookup or requested from the District Court clerk. The court location is Fourth and Pine Street in Mosquero, with phone 575-673-2252. Case Lookup can show public case information, but it does not provide downloadable pleadings or certified decrees.
A divorce file may include the petition, answer, temporary orders, child-support documents, property orders, notices, final decree, and docket entries. Sensitive child, financial, address, protection-order, and personal-identifier material may be sealed or redacted. For the court-case side of a divorce, use the same access rules that apply to Harding County civil and domestic court records.
Bankruptcy cases sometimes affect property or debt after a divorce, but they are still federal court records. The PACER bankruptcy court lookup is separate from Harding County divorce records.
That distinction helps prevent a common search error: a divorce decree is requested from District Court, while a later bankruptcy filing is searched through PACER.
Note: County Clerk marriage records and District Court divorce records should be requested from the office that maintains each record.
